Terms of Use

1. Provider and scope

The App is provided by the entity named in the imprint. These terms apply to all users of the App. Our privacy policy applies in addition.

2. The App

The App is a digital collecting game built around the coats of arms of the Confederation, the 26 cantons and the municipalities. You open “packs”, fill a collector’s album, explore the arms in the atlas, play the place-the-crest game, trade arms and compete on leaderboards. The App is continuously developed; individual features may change, be added or be removed.

3. Account and sign-in

You sign in via an external provider (Google, Facebook) or as a guest — no password is set. You are responsible for the activity under your account and keep your details current. Guest accounts are tied to your device and may be deleted after extended inactivity. As a rule, one account per person is intended.

4. Taler and virtual goods

The App contains a virtual currency (“Taler”) as well as virtual goods (packs, arms, editions). These:

• have no monetary value and cannot be converted into money or paid out outside the App;
• grant a simple, revocable right of use within the App and are not “bought” in the sense of ownership;
• may — where the App provides for it — be traded or redeemed for Taler; there is no entitlement to any particular exchange rate;
• may be adjusted, reset or discontinued by us where there is an objective reason (e.g. game balance, abuse, discontinuation of the service).

5. Fair use

You undertake not to misuse the App. In particular, you refrain from:

• using the App by automated means (bots, scripts), circumventing security measures or exploiting bugs/loopholes;
• manipulating game state, Taler or trading mechanics, or gaining unfair advantages;
• harming the App, other users or third parties, or breaching applicable law.

6. Content and rights

Coats of arms are heraldic official emblems. In the App they are recreated or — where real imagery is used — sourced from open repositories (notably Wikimedia Commons) under their respective licences; source and licence are credited where required. Official emblems may not be used outside the App in a way that feigns an official status. Other content and the design of the App are protected by copyright.

7. Availability and warranty

We strive for reliable operation but cannot guarantee uninterrupted availability. Maintenance, further development or technical faults may cause interruptions. The App is provided “as is”.

8. Liability

We are liable only for damage caused intentionally or through gross negligence. Liability for slight negligence as well as for indirect and consequential damage (in particular for lost game state or virtual goods) is excluded to the extent permitted by law.

9. Suspension and termination

You may stop using the App at any time and request deletion of your account (see privacy policy, section 9). We may restrict or suspend accounts in the event of breaches of these terms. On termination, the rights of use in virtual goods and Taler lapse; no monetary compensation is paid.

10. Changes to these terms

We may amend these terms when the App or the legal situation changes. The version published here at the relevant time prevails. We will indicate material changes in an appropriate manner.

11. Governing law and place of jurisdiction

Swiss law applies, excluding its conflict-of-laws rules. Mandatory consumer protection provisions of your country of residence remain reserved. The exclusive place of jurisdiction is — to the extent permitted — [TO COMPLETE: place], Switzerland.
